Rutherford Institute Asks Supreme Court to Declare Individual Mandate Provision of Obama Administration’s Healthcare Reform Unconstitutional

February 14, 2012

WASHINGTON, DC— The Rutherford Institute has filed an amicus curiae brief with the U.S. Supreme Court in a case that will determine whether the major overhaul of the nation’s healthcare financing system adopted by Congress in 2010 will survive. The Institute’s brief in U.S. Dept. of Health & Human Services v. State of Florida asks the Court to strike down the “Individual Mandate” provision of the Patient Protection and Affordable Care Act of 2010, which requires almost all Americans to purchase health insurance, as an unwarranted and unprecedented exercise of power by the federal government. Arguing that by enacting the Individual Mandate “Congress has intruded on individuals’ rights to make private decisions about their own health and in the process has disrupted the federal-state balance” of power, Rutherford Institute attorneys have asked the Supreme Court to uphold a lower court ruling that the Individual Mandate is an improper exercise by Congress of its authority to regulate interstate commerce.

“No American should be penalized for choosing not to have health insurance,” said John W. Whitehead, president of The Rutherford Institute. “The Individual Mandate provision of the Obama Administration’s Healthcare Reform legislation is an unprecedented exercise of federal power in a field that has historically been a province of the states.”

After taking office in 2009, President Barack Obama embarked on a legislative initiative to overhaul the nation’s health care system, resulting in the enactment of the Patient Protection and Affordable Care Act of 2010. An integral part of the legislation is the Individual Mandate which commands that, with limited exceptions, all individuals within the United States ensure that they and their dependents are covered by a minimum level of health insurance each month. Individuals who fail to comply with the Individual Mandate are subject to penalty which is statutorily set at $695 per person, including those for whom the noncompliant person is responsible. The Act provides that Congress enact the Individual Mandate under its power to regulate “interstate commerce” as set forth in Article I, § 8 of the U.S. Constitution. Shortly after its enactment, Florida and 12 other states filed a lawsuit challenging various aspects of the Act, including the Individual Mandate, arguing that Congress had exceeded its power under the Interstate Commerce Clause. In August 2011, the U.S. Court of Appeals for the Eleventh Circuit upheld the states’ claim that the Individual Mandate was unconstitutional and constituted an unprecedented exercise of authority by Congress in requiring persons to purchase a product for the remainder of their lives.

In their amicus brief, Rutherford Institute attorneys ask the U.S. Supreme Court to affirm the appeals court’s decision, arguing that a ruling upholding the Individual Mandate “has implications not only as to the freedom of citizens to decide how to provide for their health care, but more broadly on the federalism embodied in the United States Constitution that is meant to preserve liberty by preventing the concentration of power in the national government.” The Institute’s brief points out that the Courts have traditionally recognized that the Constitution permits states to make general health and welfare decisions for the public good, and that the Individual Mandate is contrary to this rule and not a “necessary and proper” exercise of Congressional authority. Alfred W. Putnam, Jr. and other attorneys with the law firm of Drinker, Biddle & Reath LLP, of Philadelphia assisted The Rutherford Institute in drafting and filing the amicus brief.

Why are Conservatives so evil for believing in private property (i.e. house, car, money, etc)? If a person is smart enough to earn his/her own money, aren’t they smart enough to know how to spend it as well?

If we could get people to stop throwing up ad hominem arguments such as greed, racism, for-the-rich and selfish every 5 seconds, then there would be hope of a fruitful dialogue. I am truly convinced that many liberals do not want an honest dialogue. Why? Because it would reveal an immoral goal of progressivism – to confiscate private earnings from individuals to that of a government monopoly.”

Takia correctly connects Marxism with Anti-God ideology, it is anathema for Christians to be involved in Communism as a political ideology.
“It is about the idea that progressives believe that private property belongs to the State (i.e. Federal Government). Someone reading this may draw the conclusion that I am exaggerating this idea of private property. Let me remind my progressive audience of the words of Karl Marx:

“The theory of the Communists may be summed up in the single sentence: Abolition of private property.” (Communist Manifesto, Chapter II ~1848)

How is this 1848 quote relevant for today? Karl Marx is long dead, but his ideology lives on. Our current President has admitted in his own book that he has surrounded himself with Marxists (See: Dreams from My Father, pgs. 99-100). Would this not have an influence on the legislation that liberals are currently pushing for? If you’re still in doubt of the Communistic influence then please explain why the Communist Party USA has endorsed President Obama for 2012?

Even the Brookings Institution exposed the principle of the modern left-wing tax policy as such:

“All revenue of individuals and corporations in the United States belongs to the government – whatever sums are left in private hands are a gift of the government.”(See: To Harass Our People, The IRS and the Abuse of Power, George Hansen, pg 169)

You might want to re-read that quote slowly and let it sink in.”

The federal agency that oversees the mortgage giants Fannie Mae and Freddie Macis set to file suits against more than a dozen big banks, accusing them of misrepresenting the quality of mortgage securities they assembled and sold at the height of the housing bubble, and seeking billions of dollars in compensation. The Federal Housing Finance Agency suits are aimed at Bank of America, JPMorgan Chase, Goldman Sachs and Deutsche Bank, among others.

Agenda 21, Sustainable Living

I found the following U.N. guidelines (shown in quotes) to implement Agenda 21/Sustainable Development on their United Nations Sustainable Human Settlement Development website. As the people of the Shire will note, we are referred to as “human settlements” and they have plans to manage us.

“Human settlement objective

A. Providing adequate shelter for all;
B. Improving human settlement management;
C. Promoting sustainable land use planning and management;
D. Promoting the integrated provision of environmental infrastructure: water, sanitation, drainage, hazardous and solid waste management;
E. Promoting sustainable energy and transport systems in human settlements;
F. Promoting human settlement planning and management in disaster-prone areas;
G. Promoting sustainable construction industry activities;
H. Promoting human resource development and capacity-building for human settlement development.

d) All countries should, as appropriate, facilitate access of urban and rural poor to shelter by adopting and utilizing housing and finance schemes and new innovative mechanisms adapted to their circumstances;

g) All countries, where appropriate, should develop and implement resettlement programmes which address the specific problems of displaced populations in their respective countries;

B. Improving human settlement management

a) Adopt and apply urban management guidelines in the areas of land management, urban environmental management, infrastructure management and municipal finance and administration”

New York City has been referred to as one of the “greenest” places on earth and used as a model for the rest of the U.S. Unfortunately being “green” means living atop each other in a mass of concrete. The Mayor has given himself the power to regulate every aspect of the lives of the residents of New York City. While this may be perfectly fine for the people of New York, it is not necessarily the way we Hobbits of the Shire wish to live.

Equate the following quote from the website to Obama’s Executive Order 13575 creating the White House Rural Council. Hobbits, you’re time in the Shire is limited unless Congress acts to stop this in it’s tracks. I’m not holding my breath on that happening.

“As appropriate, they should also concentrate on activities aimed at facilitating the transition from rural to urban lifestyles and settlement patterns “
